Clear rules. Responsible creation.
These Terms govern access to and use of A Play, including viewing videos, creating a Screen, uploading content, interacting with other users and using related features available through AbhhyamPlay.com.
About These Terms
These Terms and Conditions (“Terms”) govern access to and use of A Play, a video-sharing platform available through AbhhyamPlay.com and operated by Theek Hai India Private Limited (“A Play”, “we”, “us” or “our”).
A Play enables eligible users to watch videos and, when enabled for their account, create a personal public space called a “Screen”, upload content, interact with other users and use related platform features.
By creating an account, uploading content or otherwise using A Play, you agree to these Terms, the Privacy Policy, Community Standards, Copyright Policy and any feature-specific rules displayed on the platform. If you do not agree, do not use A Play.
Eligibility
During the initial startup phase, A Play is intended for persons who are at least 18 years old and legally capable of entering into a binding agreement. By registering, you confirm that you satisfy these requirements.
A person below 18 years must not create an account, create a Screen or upload content unless A Play introduces an approved child-access process with the legally required safeguards and verifiable parental or guardian consent.
An organisation may use A Play only through an authorised representative who has authority to bind that organisation to these Terms.
Accounts and Security
You must provide accurate, current and complete registration information and keep it updated. You are responsible for activity conducted through your account and for maintaining the confidentiality of your credentials and verification codes.
You must promptly notify A Play through its Help or Grievance facility if you suspect unauthorised access, impersonation or compromise. We may request reasonable verification before restoring access or changing sensitive account information.
- Do not create accounts using false identities or another person’s information.
- Do not sell, transfer, rent or share an account in a manner that creates security or identity risks.
- Do not attempt to bypass account restrictions or create replacement accounts after suspension without written permission.
Screens
A Screen is the creator identity and public content space provided by A Play. Screen names, handles, profile images and descriptions must not impersonate another person, infringe intellectual-property rights or falsely suggest official endorsement.
A Play may require verification for official, organisational, high-reach, monetised or otherwise sensitive Screens. A verification badge confirms completion of the applicable process; it is not an endorsement of every statement, product or activity of the Screen owner.
Your Content and Ownership
You retain ownership of the content you upload, subject to any rights held by others. You must own the content or possess all permissions, licences, releases and legal rights necessary to upload, publish, monetise and share it.
By uploading content, you grant A Play a non-exclusive, worldwide, royalty-free and sublicensable licence to host, store, reproduce, transcode, adapt for technical formats, display, distribute, recommend and promote that content solely for operating, improving and promoting A Play and its services. This licence continues while the content is available and for a reasonable technical, backup, legal or dispute-resolution period after deletion.
You also permit viewers to access and share eligible public content through the functions made available by A Play. No user receives ownership merely by viewing or sharing content.
Creator Responsibilities
Before publishing, you must check the accuracy, legality, rights, context, title, thumbnail, description, audience setting, location label and promotional disclosures associated with your content.
- Clearly disclose sponsored, paid, affiliate or promotional content.
- Clearly identify materially altered or synthetic media where required by A Play or applicable law.
- Obtain consent before publishing another person’s private information, image or voice where consent is legally required.
- Use accurate titles and thumbnails that reasonably represent the video.
- Maintain records of licences, permissions, releases and factual support for material claims.
Prohibited Content and Conduct
Users must not upload, publish, promote, share or engage in content or conduct that is unlawful, harmful, deceptive, abusive or contrary to A Play policies. Prohibited material includes, without limitation:
- Child sexual abuse material, child exploitation or content endangering minors.
- Terrorist or violent-extremist promotion, credible threats or incitement to violence.
- Non-consensual sexual content, sexual exploitation or unlawful obscene material.
- Hate speech, targeted harassment, bullying, doxxing or unlawful discrimination.
- Fraud, scams, phishing, impersonation, pyramid-style deception or fabricated earning, employment, investment, pension, health or government-association claims.
- Misleading guarantees of income, returns, jobs, benefits, approval or eligibility.
- Copyright, trademark, privacy, publicity or other rights infringement.
- Malware, malicious links, credential theft or unauthorised data collection.
- Spam, repetitive mass posting, artificial views, fake likes, automated engagement or manipulation of recommendations.
- Sale or promotion of illegal or restricted goods and services.
- Instructions designed to evade law, safety controls, moderation or platform restrictions.
A Play is not required to accept content merely because another platform has restricted or removed it. Every item will be assessed under applicable law and A Play policies.
Moderation and Enforcement
A Play may use automated tools and human review to identify possible violations. We may request information, restrict recommendations or monetisation, apply an age gate, disable features, remove content, issue warnings or strikes, suspend a Screen or terminate an account where reasonably necessary.
Where appropriate, we aim to provide a reason and an opportunity to correct an ordinary mistake or appeal a decision. Immediate restriction or removal may occur for serious illegality, urgent safety risks, repeated violations, fraud, child-safety concerns, court orders or valid government requests.
Automated detection is an indicator and does not necessarily establish a violation. Eligible disputed decisions may be submitted for human review through the appeal facility.
Copyright and Intellectual Property
A Play respects intellectual-property rights. Rights holders may submit a complaint through the Copyright or Grievance facility with identification of the protected work, the allegedly infringing content, contact details, a good-faith statement and supporting authority.
The uploader may be offered an opportunity to remove, mute, replace or dispute the affected material, or submit a legally valid counter-notice where applicable. A Play may remove content, preserve relevant records and restrict repeat infringers in accordance with applicable law and platform policy.
Knowingly false or abusive copyright complaints or counter-notices may result in restriction and legal consequences.
Public Content and User Interactions
Public videos, Screen information, comments and other public activity may be viewed, indexed, linked, embedded, copied or shared by others. Do not publish information that you wish to keep confidential.
Creators may control certain features such as comments, visibility and downloads where those controls are available. A Play does not guarantee that third parties will delete copies previously made outside the platform.
Users are responsible for their interactions with other users. Report suspected fraud, threats, harassment or unsafe conduct rather than engaging in retaliation.
Recommendations and Area-Based Distribution
A Play may organise or recommend content using signals such as selected language, state, district, area, interests, followed Screens, watch activity, recency and engagement. Recommendations do not constitute endorsement, certification or a promise of reach.
Creators must assign accurate location labels. Location priority may increase relevance in a region but does not guarantee impressions, views, registrations or business results.
Promotions, Opportunities and External Transactions
Videos may describe businesses, employment, entrepreneurship, products, services, registrations or community initiatives. Unless A Play expressly states otherwise in writing, content uploaded by a user is that user’s representation and not a guarantee or endorsement by A Play.
Users must independently review eligibility, contracts, prices, licences, financial commitments and risks before entering any external transaction. A Play is not a party to an arrangement completed outside the platform merely because the parties met through A Play.
Payments and Monetisation
At initial launch, some payment, advertising, tipping, membership or monetisation features may not be available. If introduced, they will be governed by additional terms, eligibility standards, tax requirements, payment-provider rules, revenue calculations, refund conditions and compliance checks presented before participation.
No creator is guaranteed monetisation, advertising revenue, minimum views, sponsorship, earnings or payment unless expressly stated in a separate written agreement.
Privacy
The A Play Privacy Policy explains how personal data is collected, used, shared, secured and retained, and how users may exercise applicable rights. By using A Play, you acknowledge that you have read the Privacy Policy.
Where consent is legally required, A Play will request a clear affirmative choice. Acceptance of these Terms does not by itself authorise every optional use of personal data.
Third-Party Services and Links
A Play may use or link to third-party hosting, video-processing, analytics, payment, communication, advertising or sharing services. Independent third-party services are governed by their own terms and privacy policies. A Play is not responsible for an independent third party’s content, availability or conduct.
Platform Availability and Changes
A Play is a developing platform. Features may be added, changed, limited, suspended or discontinued for technical, operational, security, commercial, legal or safety reasons. We do not guarantee uninterrupted, error-free or permanent availability.
Users should retain original copies of uploaded content. A Play is not intended to be the creator’s only archive or backup.
Disclaimers
To the maximum extent permitted by applicable law, A Play is provided on an “as available” basis. We do not guarantee the accuracy, completeness, legality, quality or reliability of user-generated content, or any particular audience reach, ranking, result, income, opportunity or outcome.
Nothing on A Play constitutes legal, financial, investment, medical, employment or government advice merely because it appears on the platform. Users should obtain appropriate independent advice before acting on material claims.
Nothing in these Terms excludes any statutory right or obligation that cannot lawfully be excluded.
Limitation of Liability
To the extent permitted by law, Theek Hai India Private Limited, A Play and their officers, employees and service providers will not be liable for indirect, incidental, special, punitive or consequential loss arising from platform use, loss of data, lost opportunity, user content, third-party conduct or external transactions.
Any limitation will apply only to the extent valid under applicable law and will not exclude liability that cannot lawfully be limited, including liability arising from fraud, wilful misconduct or other non-excludable obligations.
Indemnity
To the extent permitted by law, you agree to indemnify Theek Hai India Private Limited against third-party claims, losses and reasonable costs arising from your content, your unlawful use of A Play, your breach of these Terms or your infringement of another person’s rights. This provision does not apply to the extent a claim was caused by A Play’s own unlawful conduct.
Suspension, Termination and Deletion
You may stop using A Play and request account deletion through the available settings or support process. Deletion is subject to reasonable processing time, backups, unresolved appeals, fraud prevention and legally required retention.
A Play may restrict, suspend or terminate access for serious or repeated violations, legal requirements, security risks, non-payment of an applicable service, prolonged inactivity under a published policy or discontinuation of the service.
Where lawful and reasonably practicable, we will provide notice and information about an available appeal or data-export process. Immediate action may be taken where delay could create legal, safety or security risk.
Appeals and Grievance Redressal
An eligible user may appeal a content or account decision using the notice, Policy Status panel, Help Centre or Grievance facility. The appeal should identify the decision, explain the claimed error and provide supporting material.
The designated Grievance Officer is Ms Harshita. Official contact details and the grievance-submission method will be maintained on the Contact Us or Grievance Redressal page of AbhhyamPlay.com.
Complaints will be acknowledged and addressed within the timelines required by applicable law. A user may pursue any external remedy available under applicable law after using the platform’s grievance process where required.
Lawful Requests and Safety
A Play may preserve, restrict or disclose information when required by applicable law, a binding court order, a valid government request, child-safety obligations or a genuine emergency involving risk of serious harm. Requests will be assessed under applicable legal and internal procedures.
Changes to These Terms
We may update these Terms for new features, operational requirements or changes in law. The revised Terms will display an updated effective date. Material changes will be notified through the website, account notice, email or another appropriate method. Continued use after the effective date constitutes acceptance where permitted by law; fresh consent will be obtained where legally required.
Governing Law and Disputes
These Terms are governed by the laws of India. Subject to any mandatory consumer, statutory or regulatory forum, disputes will be submitted to the competent courts having jurisdiction over the registered office of Theek Hai India Private Limited.
Before initiating proceedings, users are encouraged to submit the matter through the A Play grievance process so that a reasonable opportunity for resolution is available.
General Provisions
If any provision is held invalid or unenforceable, the remaining provisions will continue to apply. Failure to enforce a provision on one occasion is not a waiver. Headings are for convenience and do not alter interpretation.
These Terms, together with incorporated policies and applicable feature-specific terms, constitute the agreement concerning use of A Play. In case of a conflict, legally mandatory requirements prevail, followed by feature-specific terms for that feature and then these Terms.
Contact
Create responsibly, respect the rights and safety of others, and use A Play in accordance with these Terms and the platform’s applicable policies.
